Man alleges woman planted baggie of meth during sex act while driving

After being pulled over for speeding in the Town of Plover, a man and woman both faces felony methamphetamine possession charges.

Tracy Baker, 46, of Black Creek, Wis., is charged with felony possession of methamphetamine and possession of narcotic drugs which both carry a maximum sentence of up to a $10,000 fine, three years and six months imprisonment or both if convicted. As Baker is a repeat offender of multiple misdemeanors and possession of THC his maximum prison sentence can be increased by a total of eight years.

Ashlee Heron, 32 of Wisconsin Rapids, is also charged with possession of methamphetamine with the same maximum sentence of up to a $10,000 fine, three years and six months imprisonment or both if convicted.

Both defendants made their initial appearance in Portage Co. Circuit Court on July 25.

According to the criminal complaint, the couple was pulled over on Hwy. 54 in the Town of Plover by a Portage Co. sheriff’s deputy at 11:39 PM on July 15. The deputy reports the driver, Baker, and passenger, Heron, were behaving suspiciously.

Another deputy soon arrived with a K-9 unit; the dog indicated the presence of controlled substances in the vehicle. Baker exited the vehicle and was searched.

During the search a baggie containing 0.3 grams of methamphetamine was found in the waistband of Baker’s underwear. Baker claimed he did not use meth and alleged that while he was driving, Heron was performing sexual acts on him using her hand, and must have placed the baggie in his waistband when he pulled his hands up during the traffic stop.

A cutoff straw used to snort drugs was also found in the back pocket of Baker’s pants.

Deputies next searched Heron’s belongings including a backpack, where they uncovered an empty syringe containing a brown substance that appeared to be heroin, a box of pseudoephedrine, seven baggies of methamphetamine, a white rubber tie-off for intravenous drug use and razor blades used to cut up controlled substances.

In the trunk of the vehicle the deputies also found 300 to 400 syringes, tin cooking caps, cotton filters, plastic baggies and other items for drug use. Four of the syringes had liquid in them which tested positive for heroin.

Baker and Heron were arrested and taken to the Portage County Jail. Deputies report that while en route Heron became unruly and tried to kick out a squad car window. She was then transferred to another squad with bars over the windows.

When Baker was questioned at the jail he denied responsibility for everything found in the vehicle and on his person.

“I’m a drug addict. I need help,” said Heron when questioned.

She also said he hadn’t used heroin since September of 2015, though officers report observing track marks on her arms. She admitted the baggies and razor blades found in her backpack belonged to her.

Heron is currently being held on a $500 cash bond. She returns to court on Aug. 8 at 8:30 AM for a preliminary hearing and arraignment.
