Teen Sex Assault Case to Move Forward, Judge Says

The judge overseeing a teen sex assault case has determined prosecutors did not intentionally delay filing charges, and the case will move forward.
Portage Co. Judge Thomas Eagon denied a request from the lawyer of Joseph Butler, 17, to dismiss charges of felonious second-degree sexual assault. Butler’s lawyer previously accused the Portage Co. District Attorney’s Office of intentionally delaying charging Butler until he could be tried as an adult.
Eagon didn’t agree, saying there was no evidence of an intentional delay, and said there is enough probable cause to continue moving the case forward.
